Refund policy

1. APPLICATION

1.1 It is specifically recorded that the contents of this Agtech@NWK E-Commerce Standard Return, Refund and Exchange Policy ("RRE Policy") are incorporated into the Agtech@NWK E-Commerce Terms and Conditions ("Terms and Conditions"), as if specified. The RRE Policy should therefore be read and considered together with the Terms and Conditions.

1.2 Any words defined in the Terms and Conditions will bear the same meaning in the RRE Policy, except to the extent as may be expressly stated otherwise.

1.3 Only the sections of the RRE Policy so specified, will apply to Unboxed Deals, reconditioned Equipment or used Equipment. Unboxed Deals refer to returned Equipment which is offered for sale at discounted prices, due to its original packaging being damaged, unsealed or misplaced, or the Equipment showing signs of handling and/or repackaging.

1.4 Nothing contained in the RRE Policy is intended to limit any of the rights that you may have in law.

1.5 Should you be dissatisfied with your purchase, you can return the Equipment to us, subject to the provisions of the RRE Policy, and we will attend thereto on the basis as set out in the RRE Policy.

2. LOGGING OF RETURNS

All returns must be logged on the Agtech@NWK E-Commerce platform (which can be accessed via the following link: www.shopagtech.co.za/contact) within 10 (ten) business days from receipt thereof, except to the extent as may be otherwise expressly provided for in the RRE Policy.

3. PREPARING YOUR EQUIPMENT FOR RETURN

3.1 To ensure that your request is processed as soon as reasonably possible, you are required to attend to the following when returning your Equipment:

3.1.1 package your Equipment safely and securely for safekeeping when in transit;

3.1.2 clearly mark your return reference number on the outside of the parcel; and

3.1.3 include all accessories and/or parts that were sold and included in the original packaging, together with the accompanying invoice.

3.2 Failure to adhere to any of the above (clause 3.1) requirements, could delay the processing of your request or result in its decline altogether.

3.3 The following Equipment is specifically excluded from being returned, which returns will not be considered for validation, nor accepted:

3.3.1 Equipment will not be accepted for return or refund nor be covered by warranty should it be damaged as a result of any one or more of the following:

3.3.1.1 negligent or incorrect use of the Equipment.

3.3.1.2 electric surge.

3.3.1.3 modifications made to the Equipment which are not provided for in the Equipment's user manual or similar literature.

3.3.1.4 Equipment not being used in accordance with specifications or intended use as per the user manual or similar literature.

3.3.1.5 Misuse/Abuse of the Equipment.

3.3.1.6 General wear and tear from the use of the Equipment.

4. UNWANTED EQUIPMENT

4.1 You can, subject to the provisions of the RRE Policy, return unwanted Equipment to us, provided:

4.1.1 it is undamaged and unused, with the original labels and stickers still attached, including the accompanying invoice;

4.1.2 it is in the original packaging, which must be undamaged and in its original condition with all seals still intact (if applicable), to the exclusion of Unboxed Deals, reconditioned Equipment and used Equipment. Please refer to our FAQs for some examples;

4.1.3 it has not been partially or entirely assembled or disassembled, physically altered, permanently installed, affixed, attached, joined, added to, blended or combined with or embedded within, other equipment or property;

4.1.4 all its parts and/or accessories are intact and included as per the original packaging;

4.1.5 you log a return on the Website within 10 (ten) business days from receipt of the Equipment. Once the said time-period has lapsed, Equipment may only be returned if defective; and

4.1.6 it is not included in the below-listed Equipment.

4.2 CHANGED YOUR MIND?

4.2.1 Should you change your mind and would like to return the Equipment for a refund, you may do so, provided the Equipment is not:

4.2.1.2 any other Equipment that we indicate on our Equipment pages from time to time.

4.2.2 The Equipment may be returned as follows:

4.2.2.1 FOR CLICK AND COLLECT: You are required to, at your own cost, deliver the Equipment to us to the branch manager of the branch where the Equipment was purchased from.

4.2.2.2 FOR DELIVERED EQUIPMENT: You are required to, at your own cost, have the Equipment delivered to us to the branch manager of the branch where the Equipment was purchased from.

4.2.3 Once we have received and inspected the Equipment, and validated your return, we will process the accompanying refund for the purchase price of the Equipment within 10 (ten) business days therefrom, subject to the provisions of clauses 4.2.4 and 9.3. If you made use of your Agtech@NWK credit facility to purchase the Equipment, your account will be credited accordingly.

4.2.4 Should your refund request be declined due to not meeting the prescribed return requirements, we will notify you thereof within 10 (ten) business days from receipt of the returned Equipment. You will be entitled to, at your cost, collect such Equipment from us within 10 (ten) business days of said notice.

4.3 WANT TO EXCHANGE?

4.3.1 Equipment can be exchanged for a different size or colour variant, provided that such variation is available. Please refer to our FAQs for some advice on making sure that your Equipment is returnable under this section.

4.3.2 An Unboxed Deal, reconditioned Equipment or used Equipment can only be exchanged for a variation of the same Unboxed Deal, reconditioned Equipment or used Equipment, if such variation is available.

4.3.3 The Equipment may be returned as follows:

4.3.3.1 FOR CLICK AND COLLECT: You are required to, at your own cost, deliver the Equipment to us to the branch manager of the branch where the Equipment was purchased from.

4.3.3.2 FOR DELIVERED EQUIPMENT: You are required to, at your own cost, have the Equipment delivered to us to the branch manager of the branch where the Equipment was purchased from.

4.3.4 Once we have received and inspected the Equipment, and validated your return as well as verified the availability of the alternatively selected variant, the exchange will be processed accordingly and within 10 (ten) business days from our receipt of the Equipment, subject to the provisions of clauses 4.3.5 and 4.3.6.

4.3.5 Kindly note that you will be liable for payment of the purchase price difference, should the alternatively selected variant be priced higher than the original variant received. Should the alternatively selected variant be priced lower than the original variant received, you will be refunded in respect of such credit balance as per clause 4.2.3, subject to the provisions of clause 4.3.6.

4.3.6 Any additional delivery costs will be for your account.

4.3.7 If the alternatively selected variant is not available, your return will be attended to as per clause 4.2.3.

4.3.8 Should your exchange request be declined due to the returned Equipment not meeting the prescribed return requirements, we will notify you thereof within 10 (ten) business days from receipt of the returned Equipment. You will be entitled to, at your cost, collect such Equipment from us within 10 (ten) business days of said notice.

4.4 NOT WHAT YOU ORDERED?

4.4.1 Should you receive the incorrect Equipment, or the Equipment received does not match the description as per the Website, and you wish to return the Equipment, the Equipment may be returned to us as follows and within 10 (ten) business days from receipt thereof (Please refer to our FAQs for some advice on making sure that your Equipment is returnable under this section):

4.4.1.1 FOR CLICK AND COLLECT: You are required to deliver the Equipment at your own cost to the branch manager of the branch where the Equipment is purchased.

4.4.1.2 FOR DELIVERED EQUIPMENT: We will, at our cost, arrange for collection of the Equipment from you, which Equipment you will be required to make available for the same upon our request.

4.4.2 Once we have received and inspected the Equipment, and validated your return, we will, at your choice, either deliver the correct Equipment to you as soon as reasonably possible (if the correct Equipment is available) and at our cost, alternatively process a refund for the purchase price of the Equipment within 10 (ten) business days from our receipt of the returned Equipment. If you made use of your Agtech@NWK credit facility to purchase the Equipment, your account will be credited accordingly.

4.4.3 Should your return not be validated, we will notify you thereof within 10 (ten) business days from receipt of the returned Equipment, including reasons for the same. You will then be entitled to, at your cost, collect such Equipment from us within 10 (ten) business days from said notice.

4.5 EQUIPMENT DAMAGED ON DELIVERY

4.5.1 Should you receive Equipment which is damaged, incomplete or missing any parts or accessories, you are required to notify us thereof in writing within 10 (ten) business days from receipt of the Equipment, by directing an email to agtech@nwk.co.za.

4.5.2 The Equipment may be returned as follows:

4.5.2.1 FOR CLICK AND COLLECT: You are required to deliver the Equipment at your own cost to the branch manager of the branch where the Equipment was purchased.

4.5.2.2 FOR DELIVERED EQUIPMENT: We will, at our cost, arrange for collection of the Equipment from you, which Equipment you will be required to make available for the same upon our request.

4.5.3 Once we have received and inspected the Equipment, and validated your return, we will, at your choice and our cost, either replace the Equipment (if such replacement Equipment is in stock), alternatively process a refund for the purchase price of the Equipment within 10 (ten) business days from our receipt of the returned Equipment. If you made use of your Agtech@NWK credit facility to purchase the Equipment, your account will be credited accordingly.

4.5.4 Should your claim not be validated, we will notify you thereof within 10 (ten) business days from receipt of the returned Equipment, including reasons for the same. You will then be entitled to, at your cost, collect such Equipment from us within 10 (ten) business days from said notice.

5. DEFECTIVE EQUIPMENT

5.1 We will at all times endeavour to deliver to you Equipment of reasonably acceptable high quality, which is in a good working order and condition, and without defects.

5.2 What is a defect? A defect is a material imperfection in the manufacture of the Equipment or any characteristic thereof, which makes the Equipment less acceptable than one would reasonably be entitled to expect under the circumstances. Please refer to our FAQs for some examples.

5.3 The following will NOT be regarded as defects and will not entitle you to the return of the Equipment under this clause 5, nor to receive a refund or an alternative form of compensation:

5.3.1 faults resulting from normal wear and tear;

5.3.2 damage arising from negligence, user abuse or incorrect usage of the Equipment;

5.3.3 damage arising from electrical surges or sea air corrosion;

5.3.4 damage arising from a failure to adequately care for the Equipment;

5.3.5 damage arising from alterations to the Equipment, which are not expressly allowed or provided for in the accompanying user manual or similar literature;

5.3.6 where the specifications of the Equipment, although accurately described on the Website and generally fit for its intended purpose, do not suit you;

5.3.7 in relation to Unboxed Deals or used Equipment, signs of handling and/or repackaging;

5.3.8 exposure to damp or water, placed in direct sunlight causing colour fading or changing, placed outside (unless specified as an outdoor item), placed too close to a heat source;

5.3.9 the Equipment was taken apart/disassembled;

5.3.10 the Equipment was permanently installed, attached or joined to other products or property; or

5.3.11 the Equipment is not defective nor affected by a quality-related issue.

5.4 This clause 5 must be read in conjunction with clauses 6 and 7 respectively.

6. STANDARD WARRANTY

6.1 If you received defective or otherwise sub-standard quality Equipment (save for direct warranty Equipment which is addressed below), you are required to notify us thereof in writing as soon as reasonably possible once you become aware of the defect or poor quality, but in any event within 6 (six) months from receipt of the Equipment (except in the case of an extended supplier warranty, which is addressed below), by directing an email to agtech@nwk.co.za or agtechvoorraad@nwk.co.za.

6.2 The Equipment may be returned as follows:

6.2.1 FOR CLICK AND COLLECT: You are required to deliver the Equipment at your own cost to the branch manager of the branch where the Equipment was purchased.

6.2.2 FOR DELIVERED EQUIPMENT: We will, at our cost, arrange for collection of the Equipment from you, which Equipment you will be required to make available for the same upon our request.

6.3 Once we have received and inspected the Equipment, and validated your claim, we will, at our choice and our cost, either replace the Equipment (if such replacement Equipment is in stock), alternatively process a refund for the purchase price of the Equipment within 10 (ten) business days from our receipt of the returned Equipment. If you made use of your Agtech@NWK credit facility to purchase the Equipment, your account will be credited accordingly.

6.4 Should your claim not be validated, we will notify you thereof within 10 (ten) business days from receipt of the returned Equipment, including reasons for the same. You will then be entitled to, at your cost, collect such Equipment from us within 10 (ten) business days from said notice.

6.5 Where there is no extended supplier warranty period, we will not be able to facilitate returns that fall outside of the abovementioned 6-month period.

6.6 Where you request a repair / replacement of an Unboxed Deal, reconditioned product or used product and a repair is not possible, we will see if we have a replacement Unboxed Deal, reconditioned product or used product in stock (which is the same product, of the same nature and type, as the one sold), but if we do not, we will credit / refund you. A product in perfect condition (that is not an Unboxed Deal, reconditioned product or used product) is not the same product as an Unboxed Deal, reconditioned product or used product. This is why Unboxed Deals, reconditioned products and used products are discounted, compared to products in perfect condition.

7. EXTENDED SUPPLIER WARRANTY (STIPULATED ON EQUIPMENT PAGE)

7.1 If you received defective or otherwise sub-standard quality Equipment in respect of which Equipment there is an extended supplier warranty period, you are required to notify us of such defect/quality concern in writing as soon as reasonably possible once you become aware thereof, but in any event within the applicable extended supplier warranty period from receipt of the Equipment, by directing an email to agtech@nwk.co.za or agtechvoorraad@nwk.co.za.

7.2 Kindly note that we will not be able to facilitate returns that fall outside of the extended supplier warranty period.

7.3 Any extended supplier warranty is subject to whatever terms and conditions the supplier or manufacturer may impose in respect thereof. These are usually stated in a brochure or leaflet inside or on the Equipment's packaging. It is your responsibility to familiarise yourself with any such terms and conditions.

7.4 It is also important to note that the remedy available to you, will be determined by the supplier or manufacturer in accordance with their discretion. Agtech@NWK is under no obligation to provide you with a refund, repair/replacement, as your remedy lies with the supplier or manufacturer.

7.5 PLEASE NOTE: Unboxed Deals, certain reconditioned Equipment and used Equipment do not have extended supplier warranties and this will be clearly displayed on the Equipment description page.

8. DIRECT WARRANTY (STIPULATED ON EQUIPMENT PAGE)

8.1 This refers to Equipment in respect whereof the supplier/manufacturer elects to manage defective returns itself, directly with you, and not through Agtech@NWK.

8.2 Under such circumstances, and should the Equipment received be defective or otherwise of sub-standard quality, you may notify us of such defect/quality concern in writing as soon as reasonably possible once you become aware thereof, but in any event within the applicable warranty period from receipt of the Equipment, by directing an email to agtech@nwk.co.za or agtechvoorraad@nwk.co.za.

We will then furnish you with the contact details for the applicable supplier/manufacturer for your referral of your complaint, with the supplier/manufacturer to assist you with your claim. Should you however experience any difficulty in this regard, you are welcome to contact us and we will assist to the extent possible.

9. CHARGES AND REFUNDS

9.1 If you return defective Equipment to us, but you fail to return all of the accessories and/or parts that were sold therewith and included in the original packaging, we will be entitled to (subject to applicable law) refuse the return, or to only replace the item that you did return; or to estimate the value of the outstanding accessories/parts and adjust the refundable amount accordingly.

9.2 Please note that you may, to the exclusion of defective Equipment, be liable to us for a reasonable amount in respect of:

9.2.1 the use of the Equipment during the time that you were in possession thereof, unless the Equipment is ordinarily consumed or depleted by use, and no such consumption or depletion has occurred; or

9.2.2 any consumption or depletion of the Equipment, unless that consumption or depletion is limited to a reasonable amount necessary to determine whether the Equipment was acceptable for you; or

9.2.3 for repackaging/restoration costs incurred by us to render the Equipment fit for re-stocking, unless, having regard to the nature of the Equipment, and the manner in which it was packaged, it was necessary for you to destroy the packaging in order to determine whether the Equipment:

9.2.3.1 conformed to the description or sample provided, in the case of Equipment that had not been examined by you before delivery; or

9.2.3.2 if the Equipment was delivered to satisfy a particular purpose, which purpose was communicated to Agtech@NWK beforehand, and within 10 (ten) business days after delivery of the Equipment to you, you found it unsuitable for that specific purpose.

9.3 Please note that all refunds to be effected by us will be executed via the same payment method as per the payment method used by you when making payment of the purchase price of the Equipment, i.e. payment by credit card will be refunded to the same credit card, payment by Instant EFT will be refunded to your nominated bank account, and payment through your Agtech@NWK credit facility will be refunded to your Agtech@NWK credit facility.

9.4 Agtech@NWK reserves the right to suspend or cancel your use of the Website or service, should we have reason to believe that you are abusing our refund request process. Should we elect to do so, we will notify you accordingly and in such a manner as we may reasonably deem fit.
